These Terms & Conditions (“Terms”), together with any policies referenced herein, govern your use of the Services and purchases made through Bernie’s Barking Nails.

You agree to provide current, complete and accurate information when placing an order or creating an account, including your contact, billing, payment and shipping information.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.

2. About Our Products

Bernie’s Barking Nails offers handmade artificial nail sets and related nail products and accessories.

Because our nail sets are created, painted and/or finished by hand, minor variations in color, pattern placement, artwork, embellishments and other details are normal and part of the handmade nature of the product. Your set may not be completely identical to product photographs or another set of the same design.

We make every reasonable effort to photograph and represent our products accurately; however, colors may appear slightly different due to lighting, photography, screen or device settings and variations in materials.

Reasonable handmade and color variations are not considered product defects.

Product descriptions, availability and offerings may be updated or discontinued from time to time. We may also limit product quantities when reasonably necessary.

3. Ready-to-Wear + Custom Nail Sets

Bernie’s Barking Nails offers both Ready-to-Wear and Custom nail sets.

Ready-to-Wear Sets

Ready-to-Wear sets are offered in the sizes, shapes, lengths and designs described in their individual product listings. Customers are responsible for reviewing the product information and selecting the appropriate options before ordering.

Custom Sets

Custom sets are created according to the sizing, shape, length, design and other specifications selected or agreed upon when the order is placed.

Custom nail sets have an estimated production time of 10–14 business days. This is production time only and does not include shipping/transit time.

Because custom products are made specifically for the purchaser, changes cannot be guaranteed once production has begun.

Bernie’s Barking Nails may contact you if additional information or clarification is needed to complete your set. Delays in receiving required information or responses may extend the estimated production time.

4. Sizing Responsibility

Proper sizing is important for the appearance, comfort and wear of artificial nails.

Customers are responsible for providing accurate measurements and/or selecting the appropriate nail size when placing an order.

Sizing instructions are provided to assist customers in determining their fit. Because Bernie’s Barking Nails cannot independently verify measurements submitted by a customer, sets ordered in an incorrect size due to customer measurement or selection error are not considered defective and are not eligible for replacement or refund.

When in doubt, please review the sizing information or contact Bernie’s Barking Nails before placing your order.

5. Orders, Accuracy, + Changes

When you submit an order, you are making an offer to purchase. Submission of an order or receipt of an automated order confirmation does not necessarily constitute final acceptance of that order.

Bernie’s Barking Nails reserves the right to decline or cancel an order when reasonably necessary, including because of product availability, pricing or listing errors, suspected fraud, inability to complete a requested customization or other circumstances that prevent fulfillment. If an accepted payment must be refunded because we cannot fulfill an order, the applicable amount will be returned using the appropriate payment method.

Please carefully review your order before submitting payment, including:

• Design

• Customization or personalization

• Quantity

• Shipping address

If you discover an error after placing your order, contact Bernie’s Barking Nails as soon as possible.

We will make reasonable efforts to accommodate requested changes when possible, but changes or cancellations cannot be guaranteed once preparation or production has begun.

Customers are responsible for providing complete and accurate order, contact and shipping information.

6. Pricing, Payment, + Promotions

Prices are displayed in the currency indicated on the website and are subject to change without notice. The price applicable to an order will generally be the price displayed when the order is submitted, subject to correction of genuine pricing or listing errors.

Applicable taxes, shipping or other charges will be displayed during checkout when required.

By submitting payment information, you represent that the information provided is accurate and that you are authorized to use the selected payment method.

Promotions, sales and discount codes may be subject to additional terms, expiration dates, product exclusions or usage limitations.

Unless otherwise stated:

• Discounts cannot be combined.

• Discounts cannot be applied retroactively to completed purchases.

• Promotional offers have no cash value.

• Promotions may be limited to available inventory.

Any material restrictions will be disclosed with the applicable promotion.

7. Processing + Production Times

Because Bernie’s Barking Nails products are handmade, orders may require production or processing time before shipment.

Custom nail sets have an estimated production time of 10–14 business days unless otherwise stated at the time of purchase.

Ready-to-Wear processing times and any product-specific timelines will be displayed on the website or applicable product listing.

Processing and production times do not include carrier transit time.

While we make every reasonable effort to complete orders within the stated timeframe, circumstances such as order volume, material availability or other unexpected events may occasionally affect production.

If a significant delay occurs, Bernie’s Barking Nails will communicate with the purchaser regarding the order.

8. Shipping + Delivery

Customers are responsible for providing a complete and accurate shipping address at checkout.

Once an order has been packaged and accepted by the shipping carrier, the package is in the carrier’s possession and Bernie’s Barking Nails no longer has control over its handling, routing or delivery timeline.

Carrier delivery dates and transit times are estimates and are not guaranteed by Bernie’s Barking Nails.

Bernie’s Barking Nails is not responsible for carrier delays, routing errors, weather disruptions or other carrier-related circumstances occurring after a package has been accepted by the carrier.

If you experience a delivery issue, please contact Bernie’s Barking Nails so we can assist with determining appropriate next steps when possible. Carrier claims, investigations or other remedies may be subject to the individual carrier’s policies.

If a package is returned to Bernie’s Barking Nails because of an incorrect or incomplete address provided by the customer, additional shipping charges may be required before the order can be resent.

9. All Sales Are Final

Due to the nature of our products and for sanitary and hygiene reasons, all sales are final.

Bernie’s Barking Nails does not accept returns or exchanges for:

• Change of mind

• Incorrect size or measurements provided or selected by the customer

• Preference regarding shape, length or design after purchase

• Normal handmade variations

• Products that have been worn, applied, altered or used

Custom and personalized products cannot be returned or exchanged once production has begun.

Nothing in this policy limits any rights or remedies that cannot legally be excluded under applicable law.

10. Damaged, Defective, or Incorrect Items

Every Bernie’s Barking Nails order is inspected before packaging, but if something isn’t right when your order arrives, please let us know promptly.

Claims involving damaged, defective, incorrect or quality-related items must be submitted within 72 hours of delivery.

Please include:

• Your order number

• A description of the issue

• Clear photographs showing the item and the problem

• Photographs of the packaging when the claim involves shipping damage

Please keep the affected product and original packaging while the claim is being reviewed.

Bernie’s Barking Nails will review each qualifying claim and determine an appropriate resolution based on the circumstances, which may include repair, replacement, store credit or refund where appropriate.

Normal handmade variations, sizing errors made by the purchaser and damage resulting from application, wear, removal or misuse are not considered manufacturing defects.

11. Application, Wear, + Product Safety

Bernie’s Barking Nails provides an Application + Care Guide as general guidance for the use of our artificial nails.

Individual results and wear time vary based on factors including natural nail condition, preparation, adhesive, application technique, lifestyle, water exposure and aftercare.

Customers are responsible for properly preparing, applying, wearing, maintaining and removing their artificial nails and for following all instructions and safety warnings supplied with any adhesive, acetone, remover, dehydrator or other nail product used.

Recommended Wear Time

Bernie’s Barking Nails recommends removing artificial nail sets after no more than approximately 2–2½ weeks of continuous wear, even if the nails still appear securely attached.

Moisture or debris can potentially become trapped between an artificial nail and the natural nail and may not always be immediately visible.

Remove artificial nails sooner if you notice lifting, separation, unusual discoloration, odor, pain, redness, swelling, irritation or another concerning change.

Never simply add adhesive underneath a lifting nail. Safely remove the artificial nail and inspect the natural nail before reapplication.

Nail Adhesive

Nail adhesive is intended for external use only and must be used according to its manufacturer’s directions and warnings.

Avoid contact with skin, eyes and mouth. Keep nail adhesive out of reach of children and pets.

Nail adhesives and related nail products may cause irritation, sensitivity or allergic reactions in some individuals. Discontinue use if you experience pain, burning, persistent redness, swelling, irritation or another concerning reaction.

Do not apply artificial nails or nail adhesive over injured, irritated, inflamed, infected or otherwise unhealthy nails or surrounding skin.

Removal

Artificial nails should never be forcibly pulled, peeled, popped or pried from the natural nail.

Improper removal can damage the natural nail. Follow the Bernie’s Barking Nails Application + Care Guide as well as manufacturer instructions for any acetone, adhesive remover or other product used during removal.

Bernie’s Barking Nails does not provide medical advice. If you experience a concerning reaction or have questions about the health of your natural nails or surrounding skin, discontinue use and consult an appropriate healthcare professional.

12. Reusability

Bernie’s Barking Nails may be reusable, but reuse is not guaranteed.

Whether a set can be worn again depends on factors including how long the nails were worn, the adhesive used, how they were removed, the condition of the nails after removal and the design or embellishments on the set.

Customers wishing to reuse their nails should follow the recommended warm-water soak removal instructions and avoid forcing or damaging the artificial nails during removal.

Before reusing a set, inspect each artificial nail. Do not reuse nails that are damaged, cracked, significantly warped or otherwise no longer in suitable condition for wear.

Nails should be cleaned and completely dry before storage or reapplication.

13. Customer Responsibility + Product Liability

By purchasing and using Bernie’s Barking Nails products, you acknowledge responsibility for:

• Selecting or providing appropriate sizing information

• Reviewing product descriptions before purchase

• Following application, wear, care and removal guidance

• Following manufacturer instructions and safety warnings for adhesives and other products

• Monitoring the condition of your natural nails during wear

• Removing artificial nails appropriately and within the recommended wear period

• Discontinuing use if pain, irritation or another concerning condition develops

Bernie’s Barking Nails is not responsible for damage to the natural nail or surrounding skin resulting from improper application or removal, extended wear, failure to follow provided instructions or manufacturer warnings, customer sizing errors, misuse or improper use of third-party products.

To the fullest extent permitted by applicable law, Bernie’s Barking Nails will not be responsible for indirect, incidental, special or consequential losses resulting from misuse of its products or failure to follow applicable instructions and warnings.

Nothing in these Terms is intended to waive, restrict or eliminate any consumer right, warranty, remedy or responsibility that cannot legally be waived, restricted or eliminated.

14. Cleanliness + Handling

Each Bernie’s Barking Nails set is handmade and prepared with care.

Nails, tools and work surfaces are handled using clean practices, and finished sets are inspected and cleaned prior to packaging.

Customers should inspect their nail set upon receipt and submit any quality-related concern within the 72-hour claim period described above and before applying or wearing the nails.

15. Website Information, Errors, + Availability

Bernie’s Barking Nails makes reasonable efforts to keep product descriptions, pricing, availability, shipping information and other website content accurate and current.

Occasionally, typographical errors, inaccuracies or omissions may occur.

We reserve the right to correct errors, inaccuracies or omissions and update information when necessary.

If an error materially affects an order already placed, Bernie’s Barking Nails may contact the purchaser regarding the error and available options, including modification or cancellation of the affected order where appropriate.

Product availability is not guaranteed until an order has been accepted.

16. Intellectual Property

Unless otherwise stated, the Bernie’s Barking Nails name, branding, logos, original product photography, graphics, written website content, original nail-art designs and other original content displayed through the Services are owned by or licensed to Bernie’s Barking Nails and may be protected by applicable intellectual property laws.
